Fraud, Theft, Damage To Property Offenses
Fraud charges include using another person’s money or identity to gain something you are not entitled to. This includes check forgery, credit card fraud, and identity fraud. Most of these offenses are felonies in Georgia.
Theft charges include taking property or money of another that is not yours. Georgia determines the level of severity of these crimes on the dollar amount of what was taken. In most instances, taking property that is valued under $1500.00 is a misdemeanor. Anything $1500 or over is a felony, with the penalty increasing as the value of the property increases. With shoplifting offenses, the misdemeanor/felony threshold is $500. Multiple prior shoplifting convictions can also make the offense a felony if a new shoplifting occurs.
Damaging property can occur in many different scenarios. Georgia classifies these offenses by monetary value of the property involved and how the property was damaged.
