Records Restrictions

One of the most prevalent questions Rachael gets asked is, “How do I get this arrest or conviction off my record?”. In certain situations, Georgia allows for you to remove arrests from your criminal history and to seal the clerks file in the county your case was in, restricting access to it from the public.

Who is eligible to restrict arrests and have their file sealed?

  • One who has successfully completed conditional discharge or first offender probation
  • One who has successfully completed a diversion program
  • One who has successfully completed Accountability Court
  • One who was acquitted of the charges after a jury trial
  • One who was arrested but no formal charges were ever filed by the prosecutor’s office
