Practice Areas:
Burglary and Robbery Offenses
Burglary is an offense that involves entering a type of structure, for instance a residence or business, without permission. The State must show that when you entered that structure, you did so with the intent to commit a theft or felony. The severity of punishment for burglary depends on what type of structure you enter.
Home invasion offenses involves entering a dwelling without permission with intent to commit a forcible felony or misdemeanor while inside. You must have been in possession of a deadly weapon or something that when used offensively could cause serious bodily injury. The dwelling must also be occupied at the time entry is made. Penalties for home invasion vary depending on whether you intended to commit a forcible felony or forcible misdemeanor while inside.
Robbery offenses involve taking property from a person. Robbery can involve taking property by snatching it from the hands of another or by force such as pushing someone down. When a weapon is involved, the offense is upgraded to Armed Robbery. Both Robbery and Armed Robbery carry lengthy sentences, with Armed Robbery having a mandatory minimum prison sentence.
